2. Scope of These Terms
These Terms apply to all orders, booking requests, enquiries, purchases, and transactions made through:
- the website lastminute-deals.shop;
- email;
- phone;
- social media, including Instagram, Facebook, TikTok, WhatsApp, or similar channels;
- third-party marketplaces or platforms where Last Minute Deals offers products or services;
- direct written communication with Last Minute Deals.
These Terms may apply to:
- travel-related offers;
- hotel, flight, transport, activity, or package-related enquiries;
- physical products;
- digital products;
- downloadable content;
- travel guides;
- online services;
- promotional offers;
- affiliate or partner offers;
- third-party supplier offers.
Additional offer-specific, supplier-specific, marketplace-specific, travel-specific, or product-specific terms may also apply. If there is a conflict between these Terms and mandatory consumer law, mandatory consumer law prevails.
3. Acceptance of These Terms
By placing an order, submitting a booking request, purchasing a product, using the website, or communicating with Last Minute Deals for a commercial transaction, the customer confirms that they have read and accepted these Terms.
If the customer does not agree to these Terms, they should not place an order or booking request.
4. Customer Eligibility and Age Requirements
Customers must be at least 18 years old to make travel bookings, enter into paid contracts, or purchase age-restricted goods or services.
Where a booking or order concerns a minor, the booking or order must be made by a parent, legal guardian, or authorised adult.
Last Minute Deals may refuse, cancel, or request verification for transactions where age, authority, identity, payment authorisation, or legal capacity is unclear.
5. Accuracy of Customer Information
The customer is responsible for providing complete, accurate, and up-to-date information.
This includes, where applicable:
- full legal name;
- email address;
- phone number;
- billing address;
- delivery address;
- passenger details;
- passport or identity-document details;
- date of birth;
- nationality;
- travel dates;
- destination details;
- special assistance requirements;
- payment information.
For travel bookings, the customer must ensure that names, passenger details, passport details, dates, destinations, and contact details are accurate before confirmation.
Errors may lead to additional charges, cancellation, refusal of boarding, refusal of service, denied accommodation, visa problems, delivery failure, supplier penalties, or other consequences. Last Minute Deals is not responsible for losses caused by incorrect or incomplete customer information, except where mandatory law provides otherwise.
6. Our Role
Depending on the offer, Last Minute Deals may act as:
- a direct seller of physical or digital products;
- a commercial intermediary;
- an affiliate or promotional partner;
- a booking-request facilitator;
- a travel intermediary where expressly stated;
- a reseller or seller where expressly stated;
- a customer-support contact point for selected offers.
Unless expressly stated in writing, Last Minute Deals does not itself operate airlines, hotels, accommodation facilities, transport providers, tour operators, activity providers, insurance companies, payment providers, delivery companies, or third-party marketplaces.
Where a third-party supplier provides the final product or service, the customer may enter into a direct contract with that supplier. In that case, the supplier’s own terms, cancellation rules, refund rules, delivery terms, baggage rules, travel rules, service conditions, and liability limitations may apply.
7. Travel-Related Offers
Travel-related offers may include hotel offers, flight offers, transport offers, activity offers, travel guides, booking assistance, travel-related recommendations, or package-related offers.
Last Minute Deals does not claim to be a licensed travel agency, tour operator, package travel organiser, regulated travel seller, or insurance provider unless this is expressly stated in writing and supported by the legally required registration, insurance, and guarantee arrangements.
Where an offer legally qualifies as a package travel arrangement or linked travel arrangement, the mandatory rights and protections required by applicable law will apply.
Customers should carefully read all offer details before booking, including:
- supplier identity;
- destination;
- travel dates;
- included and excluded services;
- baggage rules;
- cancellation terms;
- refund terms;
- change fees;
- payment deadlines;
- visa requirements;
- passport validity requirements;
- health or entry requirements;
- insurance recommendations;
- supplier-specific rules;
- local taxes or fees;
- resort fees, city taxes, or destination charges.
The customer is responsible for ensuring that they meet all passport, visa, health, vaccination, immigration, travel-document, and entry requirements for the destination and transit countries.
8. Flights, Airlines, Hotels, and Third-Party Travel Providers
For flight-related issues such as delay, cancellation, denied boarding, downgrade, baggage loss, baggage delay, or airline disruption, the customer may have rights directly against the operating airline under applicable passenger-rights rules.
For hotel, accommodation, transport, or activity bookings, the relevant supplier’s conditions may determine cancellation, changes, refunds, check-in requirements, security deposits, local charges, and service rules.
Last Minute Deals may assist with communication, rebooking, or refund requests where reasonably possible, but cannot guarantee that a supplier will approve a refund, change, credit, upgrade, or exception.
9. Travel Prices and Availability
Travel prices may change quickly and may depend on supplier availability, dates, exchange rates, taxes, fees, demand, destination, passenger numbers, room type, fare class, baggage, and booking conditions.
A travel price is not guaranteed until the booking is confirmed in writing and, where required, paid in full.
Last Minute Deals may charge a service fee, booking-assistance fee, processing fee, consultancy fee, or administrative fee where this is clearly communicated before the customer confirms the transaction.
Unless otherwise stated, service fees charged by Last Minute Deals are separate from supplier charges and may be non-refundable once work has started or the service has been performed, subject to mandatory consumer law.
10. Travel Cancellations, Changes, and Refunds
Travel cancellations, changes, and refunds depend on:
- the type of offer;
- the supplier’s own terms;
- airline or hotel rules;
- fare conditions;
- booking class;
- travel dates;
- cancellation deadlines;
- whether the booking is refundable, partially refundable, or non-refundable;
- whether mandatory law provides additional rights.
If the customer cancels, supplier cancellation rules and any applicable Last Minute Deals service fees may apply.
If the supplier cancels, Last Minute Deals may assist the customer in requesting a refund, alternative service, credit, rebooking, or supplier-proposed solution.
If disruption is caused by force majeure or events outside reasonable control, refunds or changes may depend on supplier terms and mandatory law.
Examples of force majeure or external disruption may include severe weather, strikes, border closures, government restrictions, war, civil unrest, epidemics, natural disasters, airline disruption, airport closures, supplier insolvency, technical failures, or safety events.
Customers are strongly advised to obtain suitable travel insurance. Last Minute Deals does not provide insurance unless expressly stated.
11. Physical Products
Where Last Minute Deals sells physical products directly, the customer will be informed of the main product characteristics, total price, delivery charges where applicable, delivery method, estimated delivery period, return rules, and applicable legal guarantees before purchase.
Delivery times are estimates unless expressly guaranteed. Delays may occur due to suppliers, couriers, customs, address errors, payment checks, stock availability, force majeure, or other external factors.
The customer must provide a correct delivery address and must ensure that delivery can be accepted.
Risk and ownership rules will be applied in accordance with applicable consumer law.
12. Digital Products and Digital Content
Digital products may include e-books, guides, downloads, digital files, online materials, templates, access links, or other electronic content.
Digital products are normally delivered by email, download link, account access, or another electronic method.
Where legally permitted, the customer may lose the right of withdrawal for digital content if the customer expressly agrees to immediate performance or immediate access and acknowledges that the withdrawal right may be lost once delivery begins.
Customers must not copy, resell, redistribute, publish, upload, share, license, or commercially exploit digital products unless expressly authorised in writing.
13. Consumer Right of Withdrawal
For many online purchases of physical goods, consumers may have a legal right to withdraw from the contract within 14 days.
The withdrawal period, conditions, procedure, and consequences depend on the type of product or service.
The right of withdrawal may not apply, or may be limited, for certain products and services, including:
- travel, accommodation, transport, catering, or leisure services provided on a specific date or during a specific period;
- package travel and certain travel-related contracts where withdrawal rights are excluded by law;
- personalised or custom-made goods;
- sealed goods that cannot be returned for hygiene or health-protection reasons once opened;
- goods that deteriorate or expire quickly;
- digital content supplied immediately with the consumer’s prior express consent and acknowledgement of loss of withdrawal right;
- services fully performed before the end of the withdrawal period with the consumer’s prior agreement, where applicable;
- products or services excluded from withdrawal by applicable law.
To exercise a withdrawal right where it applies, the customer must contact:
The customer must clearly state that they wish to withdraw from the contract and must provide sufficient information to identify the order.
Returned goods must be unused, complete, and returned in suitable condition unless the issue concerns a defect, lack of conformity, or legal guarantee claim.
Return costs may be borne by the customer unless mandatory law, offer-specific terms, or a defect-related claim provides otherwise.
14. Legal Guarantees and Faulty Products
Where Last Minute Deals sells products directly to consumers, mandatory legal guarantees apply.
If a product is defective, not as described, not fit for normal use, or non-conforming, the customer should contact Last Minute Deals as soon as possible with:
- order reference;
- description of the issue;
- photos or evidence where useful;
- preferred remedy where applicable.
Available remedies may include repair, replacement, refund, price reduction, or another remedy required by applicable law.
Nothing in these Terms limits mandatory legal guarantee rights.
15. Orders, Confirmation, and Contract Formation
An order, purchase, or booking request is not necessarily accepted immediately when submitted.
A contract is formed only when Last Minute Deals or the relevant supplier confirms acceptance in writing, by email, on the website, through the marketplace, or through another durable communication method.
Last Minute Deals may refuse or cancel an order or booking request where:
- the product or offer is unavailable;
- the supplier rejects the booking;
- payment fails;
- fraud is suspected;
- customer information is incomplete or inaccurate;
- there is an obvious pricing or technical error;
- legal, regulatory, sanctions, travel, or safety restrictions apply;
- the order violates these Terms;
- performance is impossible or commercially unreasonable due to external circumstances.
If payment has already been made and the order is refused or cancelled, the customer will receive a refund where legally required, subject to supplier rules and mandatory law.
16. Prices, Taxes, and Fees
Prices are shown in the currency stated on the relevant offer page, checkout page, invoice, marketplace listing, email, or booking confirmation.
Prices may include or exclude taxes, delivery fees, booking fees, supplier fees, service fees, local charges, tourist taxes, customs duties, or destination charges depending on the offer.
Before confirming a paid transaction, the customer should review the total price and any additional charges shown.
For international orders, the customer may be responsible for customs duties, import taxes, local taxes, courier charges, or destination-specific fees unless expressly stated otherwise.
17. Payments
Payments may be processed by third-party payment providers, card processors, banks, payment platforms, marketplaces, or other secure payment systems.
The customer confirms that they are authorised to use the payment method provided.
Last Minute Deals may cancel or suspend an order if payment is refused, reversed, charged back, suspected to be fraudulent, or otherwise not received.
Chargebacks, payment disputes, or unauthorised payment claims may result in suspension of service, cancellation of orders, debt recovery, additional evidence requests, or legal action where justified.
18. Promotions, Discounts, and Last-Minute Deals
Promotions, discounts, last-minute offers, vouchers, coupon codes, and special deals may be limited by time, availability, quantity, geography, supplier rules, product category, travel dates, customer eligibility, or other conditions.
Last Minute Deals may correct obvious promotional errors, pricing errors, coupon errors, or availability errors, subject to mandatory consumer law.
Promotions cannot be combined unless expressly stated.
19. Third-Party Marketplaces and Platforms
Where products or services are sold through third-party marketplaces or platforms, the platform’s own terms, payment rules, buyer-protection rules, return rules, complaint process, and account rules may also apply.
If there is a conflict between marketplace rules and these Terms, the marketplace rules may apply to the platform transaction, subject to mandatory law.
20. Customer Communications
Customers may contact Last Minute Deals by email, phone, website forms, social media, or messaging channels where available.
Calls are not recorded unless the customer is informed otherwise.
The customer is responsible for monitoring their email, phone, spam folder, messaging apps, and communication channels for order updates, booking confirmations, supplier messages, payment requests, refund updates, or urgent travel information.
21. Data Protection
Personal data is processed in accordance with the website’s Privacy Policy.
Customers should read the Privacy Policy to understand what personal data is collected, how it is used, who it may be shared with, how long it may be retained, and what rights customers have.
22. Website Use
Users must not:
- use the website for unlawful, fraudulent, misleading, abusive, or harmful purposes;
- submit false personal, payment, booking, or delivery information;
- interfere with website security or operation;
- attempt unauthorised access to accounts, systems, servers, databases, or restricted areas;
- use bots, scrapers, crawlers, or automated extraction tools without written permission;
- copy, reproduce, extract, republish, sell, or commercially exploit website content without authorisation;
- misuse offers, vouchers, refund systems, chargebacks, or complaint mechanisms.
Last Minute Deals may block, suspend, refuse, or report abusive, fraudulent, or unlawful activity.
23. Intellectual Property
All content on the website, including text, images, graphics, layouts, logos, product descriptions, guides, digital products, branding, and commercial materials, belongs to Last Minute Deals, Raphael Follana, or licensed third parties unless otherwise stated.
No website content may be copied, reproduced, distributed, modified, scraped, republished, sold, or commercially used without prior written permission.
24. Liability
Last Minute Deals is responsible only to the extent required by applicable law.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including mandatory consumer rights, legal guarantees, fraud, intentional misconduct, gross negligence, personal injury caused by proven fault, or any other liability that cannot be excluded by law.
Subject to mandatory law, Last Minute Deals is not responsible for:
- third-party supplier failures;
- airline delays or cancellations;
- hotel issues caused by the hotel or accommodation provider;
- baggage loss or delay caused by carriers;
- visa refusal or immigration issues;
- incorrect customer information;
- customer failure to meet travel requirements;
- force majeure;
- supplier insolvency;
- marketplace errors;
- payment-provider issues;
- courier delays outside our control;
- misuse of products;
- unauthorised account or payment use;
- indirect losses, loss of opportunity, loss of enjoyment, loss of profit, or consequential loss, except where such limitation is prohibited by law.
Where Last Minute Deals acts only as an intermediary, affiliate, or booking facilitator, liability for the final service may rest with the relevant supplier, subject to mandatory law.
25. Force Majeure
Last Minute Deals is not liable for failure or delay caused by events outside reasonable control.
Such events may include natural disasters, extreme weather, strikes, transport disruption, war, terrorism, civil unrest, epidemic, pandemic, government restrictions, border closures, supplier failure, airline disruption, cyberattacks, payment-system failures, hosting failures, power outages, technical failures, or other circumstances beyond reasonable control.

- customer name;
- order or booking reference;
- description of the issue;

- requested solution.
Last Minute Deals aims to respond to complaints within 14 business days.
27. Consumer Mediation
Consumers may have the right to use a consumer mediation service free of charge after first submitting a written complaint to Last Minute Deals.
The competent consumer mediation details will be provided where legally required and once the applicable mediation service has been confirmed.
28. Online Dispute Resolution
The former European Commission Online Dispute Resolution platform has been discontinued and is no longer available.
Consumers may still use applicable national consumer mediation or dispute-resolution mechanisms.
29. Governing Law and Jurisdiction
These Terms are governed by French law.
If the customer is a consumer resident in another country, mandatory consumer-protection rules of the customer’s country of residence may also apply where required by law.
Before starting legal proceedings, the parties should first try to resolve the dispute amicably.
If no amicable solution is reached, the competent courts will be determined in accordance with applicable French and European jurisdiction rules.
Nothing in this clause removes mandatory consumer rights or mandatory jurisdiction protections.
30. Changes to These Terms
Last Minute Deals may update these Terms from time to time to reflect legal, technical, operational, supplier, commercial, or service changes.
The updated version will be posted on the website with a revised effective date.
The version applicable to a transaction is normally the version in force at the time the order, booking request, or purchase was confirmed, unless mandatory law requires otherwise.
